Terms of use
Effective Date: June 1, 2025
By using this website, you agree to be bound by these Terms of Use. If you do not agree, please do not use our site.
- You must be at least 18 years of age, legally present in the United States, and legally permitted to purchase and possess body armor under the laws of your state and locality.
- You are responsible for complying with all applicable local, state, and federal laws regarding the purchase, use, and possession of body armor.
- You may not use any Ballistic Defence LLC product or this website for any unlawful purpose.
- All content on this website is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use any content without prior written permission from Ballistic Defence LLC.
Changes to these terms
We may update these Terms of Use at any time. In the event of a material change, we will provide notice via email or a prominent notice on our website at least 14 days before the change takes effect. Your continued use of this site after the effective date of any change constitutes your acceptance of the revised terms. The current effective date is displayed at the top of this page.
Limitation of liability
To the maximum extent permitted by applicable law, Ballistic Defence LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind arising from or related to your use of this website, any products purchased, or any information provided herein, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from a product purchase shall not exceed the amount you paid for the specific product giving rise to the claim.
This website and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
Governing law
These Terms of Use are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from your use of this website or purchase of products shall be subject to the jurisdiction of the state and federal courts located in Seminole County, Florida, except as otherwise provided in the Dispute Resolution section below.
Dispute resolution
Please read this section carefully. It affects your legal rights.
Informal resolution
Before initiating any formal proceeding, you agree to first contact us at info@ballisticdefence.com and provide a written description of your dispute. We will attempt to resolve the matter informally within 30 days of receiving your notice.
Binding arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy Policy, or your purchase of any product from Ballistic Defence LLC — including claims of fraud, misrepresentation, or statutory violations — shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Arbitration shall take place in Seminole County, Florida, or remotely by mutual agreement. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exceptions
The following are excluded from mandatory arbitration and may be brought in court:
- Claims within the jurisdiction of a small claims court (typically under $10,000)
- Claims for injunctive or equitable relief to protect intellectual property rights
Class action waiver
You agree that any dispute shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class or representative action. The arbitrator may not consolidate more than one person's claims.
Note: This arbitration clause has been drafted in good faith based on standard U.S. e-commerce practice. Ballistic Defence LLC recommends consulting a qualified Florida attorney before relying on this provision in any legal matter.
